Terms of Service for 101 Birds

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "your"), and DEER MOUSE LLC, dba “101 Birds”. ("we," "us," or "our"), concerning your access to and use of the 101birds.com website (the "Site") and the purchase and use of our digital products. By accessing the Site or purchasing our products, you agree that you have read, understood, and agree to be bound by all of these Terms.
2. Intellectual Property and Limited License
The Site and all of its original content, features, and functionality—including but not limited to all PDF bird guides, text, and logos—are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
When you purchase a PDF guide from 101birds.com, you are purchasing a non-exclusive, non-transferable, single-user license for personal, non-commercial use only.
You agree NOT to:
Reproduce, duplicate, copy, sell, resell, or exploit any portion of our products.
Share, distribute, or transmit the PDF files to others, privately or publicly.
Alter, modify, or create derivative works based on our products.
Post the digital files on any website, network, or shared drive.
3. Purchases and Merchant of Record
We sell digital PDF guides. We do not offer subscription services.
Our order process is conducted by our online reseller and Merchant of Record, Paddle.com. Paddle is the Merchant of Record for all our orders. This means that when you make a purchase, you are completing a transaction with Paddle, not directly with us.
By making a purchase, you also agree to Paddle's Buyer Terms, including Paddle’s Refund Policy. All customer service inquiries relating to the financial transaction, payment processing, or billing will be handled primarily by Paddle, though we are available to assist with product delivery and content issues.
4. Refunds and Returns
Because our products are digital PDF downloads, all sales are considered final and non-refundable, with some exceptions as described in Paddle’s Refund Policy.
If you experience technical issues when downloading or using one of our digital products, please contact us within seven business days for support.
5. Disclaimer of Warranties
Our bird guides, charts, and illustrations are provided on an "as-is" and "as-available" basis for educational and informational purposes. While we strive for scientific accuracy in our illustrations and field information, we make no warranties, expressed or implied, regarding the completeness, accuracy, reliability, or suitability of the information provided. Bird identification can be subjective and environmental conditions vary; we are not liable for any misidentifications or actions taken based on the content of our guides.
6. Limitation of Liability
To the fullest extent permitted by law, in no event will DEER MOUSE LLC, its partners, directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Site or the digital products purchased through the Site, even if we have been advised of the possibility of such damages.
7. Governing Law and Dispute Resolution
These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in New York, and you hereby consent to the personal jurisdiction and venue therein.
8. Changes to These Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the "Effective Date" of these Terms. It is your responsibility to periodically review these Terms to stay informed of updates. Your continued use of the Site after any revisions become effective constitutes your acceptance of the revised terms.
